The promotion will be called “Pluteus Giveaway” (the “Promotion”), and will have international scope, (any person who meets the registration requirements may participate).

The communication will be made through Instagram and different collaborators from the Art Toys sector (Blogs). We are not responsible for unauthorized communications that may appear published or disseminated by any means or channel, whether printed or digital.

Two (2) winners and two (2) alternate winners will be randomly selected from the total registered for the giveaway.

La promoción se denominará “Sorteo Pluteus” (la “Promoción”), y tendrá alcance internacional, (podrá participar cualquier persona a nivel mundial que cumpla con los requisitos de inscripción).

La comunicación se realizará a través de Instagram y distintos colaboradores del sector de los Art Toys (Blogs). No nos hacemos responsables de comunicaciones “no oficiales” que puedan aparecer en medios tanto impresos como digitales.

SOLO Contemporary, will contact the winners, privately, via email, in order to verify that they meet all the requirements established in these Terms and Conditions.

In the event that any of the selected winners reject the Prize or do not meet the requirements established in these Terms and Conditions, SOLO Contemporary reserves the right to deliver their Prize to the first valid alternate winner, and failing that, to the second alternate winner, with the sole objective of delivering the Prize.

The selected participants must provide all the data that SOLO CONTEMPORAY requires to send the prize within a period of seven (7) calendar days after the official communication of the winner.

The prize does NOT include any expenses that are not specified in these legal terms, (customs taxes or any tax derived from the laws of the winner’s country of residence). SOLO CONTEMPORAY will be responsible for all shipping costs of the Prize to the winners of the giveaway.

Para participar en la Promoción, además de cumplir los requisitos y condiciones de carácter general que se describen más adelante, se deberán realizar las siguientes actuaciones:

-Aceptar los términos y condiciones y las bases del sorteo.

SOLO Contemporary, se pondrá en contacto con los ganadores, de forma privada, a través del correo electrónico, con la finalidad de comprobar que el mismo ha cumplido con todos los requisitos establecidos en las presentes Bases.
En el caso de que alguno de los seleccionados rechace el Premio o no reúna los requisitos establecidos en las presentes Bases, SOLO Contemporary se reserva el derecho de entregar su Premio al siguiente participante válido suplente, con el único objetivo de entregar el Premio, aplicándose lo anterior igualmente para el mismo.
Los participantes finalmente seleccionados deberán proporcionar todos los datos que SOLO CONTEMPORAY requiera para hacer el envío del premio en un plazo de siete (7) días naturales tras la comunicación oficial del ganador.
El premio NO incluye ningún gasto que no esté especificado en estas bases legales, (impuestos de aduana o cualquier impuesto derivado de las leyes del en el país de destino).
SOLO CONTEMPORAY se hará cargo del gasto de envío de las figuras a los ganadores del sorteo.

6.2. The Prize, in no case may be subject to change, assignment, alteration, compensation or conversion into money at the request of the winner.

6.3. By accepting these Promotion and, and in its case, after accepting the Prize, the winners expressly authorize SOLO CONTEMPORAY to use their name and image in a limited way exclusively with regard to the dissemination activities related to this promotion (among others, without limitation, for television channels, press, internet, radio) for advertising and / or dissemination purposes, without having the right to receive payment or consideration for it. The participants, by the mere fact of participating in this Promotion, assign to SOLO CONTEMPORAY the rights of their image (image, voice and graphic representation) and of the materials and contents presented for the Promotion, for their treatment through any system and support that allows to fix, insert, disseminate, reproduce, disclose, communicate and publicly exploit the same with the image of SOLO CONTEMPORAY all without any type of temporal or territorial limitation and without giving rise to any type of remuneration or consideration by SOLO CONTEMPORARY.

For these purposes, the references made to "any system and medium" must be interpreted extensively to any medium that allows the fixation, reproduction, distribution and public communication of the image and voice of the transferor (with an enunciative and non-limiting character , press, television, cinema, internet, mobile devices, etc.) to use the design of the images and voice, in all kinds of advertising actions such as presentations and events organized by SOLO CONTEMPORARY.

6.4. ONLY CONTEMPORAY reserves the right to review the contents and materials that, where appropriate, the participants may have submitted for the Promotion and be able to eliminate those that do not meet the characteristics provided in these Terms or that may be offensive, infringe any third party rights or contain information that, in the opinion of SOLO CONTEMPORARY, is not appropriate.

6.5. SOLO CONTEMPORAY reserves the right to remove justifiably from the Promotion any participant who defrauds, alters, disables the proper functioning and the normal and regulatory course of the Promotion or who could cause any damage to the image of SOLO CONTEMPORARY.

Likewise, SOLO CONTEMPORARY may, in the case of detecting a fraudulent use of the giveaway, modify these Terms in those provisions that are pertinent to achieve the correct functioning of the same.

6.6. SOLO CONTEMPORAY reserves the right to modify or expand these Terms, in which case this fact will be notified by the same means in which these Terms are made known to all participants, giving the modification the same degree of publicity.

6.7. SOLO CONTEMPORARY will be exempt from all responsibility, obligation or compensation to the participants, if due to force majeure or legal imperative the present Promotion should be canceled or suspended, in whole or in part, a situation that would be conveniently made known to the participants.

6.8. The data provided by the participants must be true. Since the data are essential for participation in this Promotion, in the event of the data being false, SOLO CONTEMPORARY will expel the participant and even if they are the winner of the Prize, it will not be delivered. It is the responsibility of each participant to adopt appropriate and pertinent security measures to ensure consented participation and avoid impersonation of their person or consent.

6.9. The mere fact of participating in this Promotion implies acceptance of these Terms and Conditions without reservation, as well as submission to SOLO CONTEMPORAY's criteria regarding the resolution of any matter arising from the Promotion.

6.10. The Prize awarded by virtue of this Promotion will be subject to the fiscal regulations established at all times.

6.11. The persons linked to the companies in charge of carrying out this Promotion, as well as the distributors, dealers, suppliers or persons linked to SOLO CONTEMPORARY through a contract of employment or provision of professional services, nor their direct relatives may not participate in this Promotion. .

6.12. The participant of this Promotion exempts SOLO CONTEMPORARY in the broadest way regarding the Law of any type of responsibility, sanction, claim, demand or cause, civil, commercial, criminal, administrative, including, of course, compensation of any nature / or nature, expenses and costs, expressly including the fees of Lawyers and Attorneys, in relation to the Promotion and the Prize. To the extent permitted by current legislation, the organizing company SOLO CONTEMPORARY will not be responsible for the following damages and losses that a user may suffer through their participation in the promotion: consequential damages, loss of income or sales; loss of business; loss of profits or loss of contracts; loss of anticipated savings; data loss; and loss of management time or office hours, and punitive damages.

6.13. Personal data protection. In accordance with Organic Law 3/2018, of December 5, on the protection of personal data and guarantee of digital rights and its implementing regulations, and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 December April 2016, regarding the protection of natural persons with regard to the processing of personal data and the free circulation of this data, the participants give their express consent for their facilitated personal data to be treated by SOLO CONTEMPORARY in order to carry out: a) any action or management related to their participation in this Promotion; b) any action that is necessary for the management and delivery of the Prize; and c) compliance with any tax or other obligations that may be applicable in relation to the Promotion.

By providing their data, the participant expressly consents to the processing of their data in order to be sent commercial, advertising and promotional communications of SOLO CONTEMPORARY products and services either by post, telephone or electronically (e- mail, sms, social networks) as well as to carry out treatments in order to adapt our communications to your profile.

To exercise the rights of access, rectification, cancellation and opposition, you can contact SOLO CONTEMPORARY, Plaza de la Independencia, 5; 28001 Madrid. The following information must be attached to the request: Name, surname and DNI, and address for notification purposes, right you wish to request and content of your request.

6.14. SOLO CONTEMPORARY are exonerated from all responsibility in case of malfunction of the electronic communication networks, or incorrect transmission of content, which prevents the normal development of the Promotion for reasons beyond SOLO CONTEMPORAY and, especially, for external acts of bad faith. Nor will they be responsible for transmission problems or loss of data not attributable to it.

6.15. For the knowledge of any litigation that may arise regarding the interpretation or application of these Terms and Conditions, both SOLO CONTEMPORARY and the participants in this giveaway expressly submit to the jurisdiction and competence of the Courts and Tribunals of the city of Madrid in the terms of what is established in article 52.3 of the Civil Procedure Law, expressly waiving any other jurisdiction that may be applicable to them. This promotional action will be governed by these Terms and Conditions and by Spanish Law.

6.1. Para participar válidamente en esta Promoción, los participantes deberán ser personas físicas mayores de edad.
La condición de mayoría de edad deberá ser acreditada mediante presentación de D.N.I. o documento acreditativo, al momento en que SOLO CONTEMPORARY contacte con el primer seleccionado (o el siguiente participante válido suplente) de conformidad con lo dispuesto en la Cláusula Quinta anterior.

6.2. El Premio, en ningún caso podrá ser objeto de cambio, cesión, alteración, compensación o conversión en dinero a petición del ganador. 

6.3. Mediante la aceptación de las presente Promoción y, en su caso, tras la aceptación del Premio, los ganadores autorizan expresamente a SOLO CONTEMPORAY  a utilizar su nombre e imagen de forma limitada exclusivamente en lo referido a las actividades de difusión relacionadas con la presente promoción (entre otros, sin carácter limitativo, para los canales de televisión, prensa, Internet, radio) con fines publicitarios y/o divulgativos, sin que tenga derecho a recibir por ello pago o contraprestación.  En particular, los ganadores de la promoción autorizan expresamente a SOLO CONTEMPORAY  a utilizar su nombre e imagen para comunicar el resultado del sorteo en la aplicación (Instagram) y en el sitio web www.6forest.com

Los participantes, por el mero hecho de participar en esta Promoción, ceden a SOLO CONTEMPORAY los derechos de su imagen (imagen, voz y representación gráfica) y de los materiales y contenidos presentados para la Promoción, para su tratamiento a través de cualquier sistema y soporte que permita fijar, insertar, difundir, reproducir, divulgar, comunicar y explotar públicamente los mismos con la imagen de SOLO CONTEMPORAY todo ello sin ningún tipo de limitación temporal ni territorial y sin que dé lugar a ningún tipo de remuneración o contraprestación por parte de SOLO CONTEMPORARY.
A estos efectos, las referencias que se hagan a “cualquier sistema y soporte” deben interpretarse de manera extensiva a cualquier medio que permita la fijación, reproducción, distribución y comunicación pública de la imagen y voz, del cedente (con carácter enunciativo y no limitativo, prensa, televisión, cine, internet, dispositivos móviles, etc.) a utilizar el diseño de las imágenes y voz, en todo tipo de acciones publicitarias tales como presentaciones y eventos organizados por SOLO CONTEMPORARY.

6.4. SOLO CONTEMPORAY se reservan el derecho de revisar los contenidos y materiales que, en su caso, los participantes hubieran podido presentar para la Promoción y poder eliminar aquellos que no cumplan con las características previstas en estas Bases o puedan resultar ofensivos, infrinjan cualesquiera derechos de terceros o contener información y que, a juicio de SOLO CONTEMPORARY no sea apropiados.

6.5. SOLO CONTEMPORAY se reservan el derecho de eliminar justificadamente a cualquier participante que defraude, altere, inutilice el buen funcionamiento y el transcurso normal y reglamentario de la Promoción o que pudiera ocasionar algún perjuicio para la imagen de SOLO CONTEMPORARY.

Igualmente SOLO CONTEMPORARY podrá, en el caso de detectar un uso fraudulento del sorteo, modificar las presentes Bases en aquellas disposiciones que fueran pertinentes para lograr el correcto funcionamiento del mismo.

6.6. SOLO CONTEMPORAY se reserva el derecho de modificar o ampliar estas Bases, en cuyo caso este hecho se notificará por el mismo medio en que se den a conocer las presentes Bases a todos los participantes, dándole a la modificación el mismo grado de publicidad.

6.7. SOLO CONTEMPORARY quedarán eximido de toda responsabilidad, obligación o compensación con los participantes, si por causa de fuerza mayor o imperativo legal hubiera de ser anulada o suspendida, en todo o en parte, la presente Promoción, situación que se pondría  convenientemente en conocimiento de los participantes.

6.8. Los datos facilitados por los participantes deberán ser veraces. Dado que los datos son esenciales para la participación en la presente Promoción, en el caso de que los mismos fueran falsos, SOLO CONTEMPORARY eliminará al participante e incluso si resultare ganador del Premio, no se le hará entrega del mismo. Es responsabilidad de cada participante adoptar las medidas de seguridad adecuadas y pertinentes para asegurar la participación consentida y evitar suplantaciones de su persona o consentimiento.

6.9. El mero hecho de participar en esta Promoción implica la aceptación de las presentes Bases sin reservas, así como la sumisión al criterio de SOLO CONTEMPORAY en cuanto a la resolución de cualquier cuestión derivada de la Promoción. 

6.10. El Premio que se entregue en virtud de la presente Promoción se someterán a la normative fiscal establecida en cada momento.

6.11. No podrán participar en esta Promoción, las personas vinculadas a las empresas encargadas de realizar la presente Promoción, así como a los distribuidores, concesionarios, proveedores ni personas vinculadas a SOLO CONTEMPORARY mediante contrato de trabajo o de prestaciones de servicios profesionales, ni sus familiares directos. 

6.12. El participante de la presente Promoción exonera de la forma más amplia que en Derecho proceda a SOLO CONTEMPORARY de cualquier tipo de responsabilidad, sanción, reclamación, demanda o causa, civil, mercantil, penal, administrativa, incluyendo, por supuesto indemnizaciones de cualquier naturaleza y/o índole, gastos y costas, con expresa inclusión de los honorarios de Letrados y Procuradores, en relación a la Promoción y al Premio. En la medida permitida por la legislación vigente, la Empresa organizadora SOLO CONTEMPORARY no será responsable de los siguientes daños y pérdidas que pudiera sufrir un usuario mediante su participación en la promoción: daños consecuenciales, pérdidas de ingresos o ventas; pérdida de negocio; lucro cesante o pérdida de contratos; pérdida de ahorros previstos; pérdida de datos; y pérdida de tiempo de gestión o de horario de oficina, y daños punitivos.

6.13. Protección de Datos de Carácter Personal. De conformidad con la Ley Orgánica 3/2018, de 5 de diciembre, de protección de datos personales y garantía de los derechos digitales y su normativa de desarrollo, y el Reglamento (UE) 2016/679 del Parlamento Europeo y del Consejo de 27 de abril de 2016, relativo a la protección de las personas físicas en lo que respecta al tratamiento de datos personales y a la libre circulación de estos datos, SOLO CONTEMPORARY informa y se otorga el consentimiento expreso para que los datos personales que se faciliten sean incorporados a un fichero de SOLO CONTEMPORARY con la finalidad de llevar a cabo: a) su participación en la presente Promoción; b) la gestión y entrega del Premio; y c) el cumplimiento de cualesquiera obligaciones fiscales o de otra índole que sean de aplicación en relación con la Promoción. Al facilitar sus datos el participante consiente expresamente el tratamiento de sus datos con la finalidad de que se le remitan comunicaciones comerciales, publicitarias y promocionales de productos y servicios de SOLO CONTEMPORARY ya sea por vía postal, telefónica o electrónica (e-mail, sms, redes sociales) así como para realizar tratamientos con el objeto de adecuar nuestras comunicaciones a su perfil.
Para ejercitar los derechos de acceso, rectificación, cancelación y oposición podrá dirigirse mediante petición escrita dirigida a SOLO CONTEMPORARY, Plaza de la Independencia, 5; 28001 Madrid. En la petición se deberá adjuntar la siguiente información: Nombre, apellidos y D.N.I., y domicilio a efectos de notificaciones, derecho que desea solicitar y contenido de su petición.

6.14. SOLO CONTEMPORARY quedan exonerado de toda responsabilidad en caso de mal funcionamiento de las redes de comunicación electrónicas, o incorrecta transmisión de contenidos, que impidan el normal desarrollo de la Promoción por causas ajenas a SOLO CONTEMPORAY y, especialmente, por actos externos de mala fe. Tampoco serán responsable y SOLO CONTEMPORARY por los problemas de transmisión o pérdida de datos no imputables a la misma.

6.15. Para el conocimiento de cualquier litigio que pudiera plantearse en cuanto a la interpretación o aplicación de las presentes Bases, tanto SOLO CONTEMPORARY como los participantes en este sorteo, se someten expresamente a la jurisdicción y competencia de los Juzgados y Tribunales de la ciudad de Madrid en los términos de lo establecido en el artículo 52.3 de la Ley de Enjuiciamiento Civil, con renuncia expresa a cualquier otro fuero que pudiera serles de aplicación.
